A will is a legal document that spells out how you want your assets and property to be distributed following your death, and how you want your minor children to be cared for. Without this document, a probate judge, or some other court official or court-appointed person, will make those decisions for you.
Hollywood is filled with stories of someone who decides to craft a totally new will at the last minute. It is usually done on a napkin or back of a piece of paper. Please take the time to have your will drafted, printed, and signed in front of two witnesses. These witnesses should be familiar with you and your signature so they will be able to verify you did, indeed, sign the will. The witnesses will also be able to corroborate that you were mentally fit to understand the scope and nature of the will.
A living will outlines what you wish to happen to you from a medical perspective if you lose the mental capacity to direct and guide your own affairs. God forbid it should happen, but if someone were to get in a terrible accident and went into a coma, a living will would inform health care professionals about a variety of issues, like whether you wanted to be on life support, whether they should withhold you from receiving nutrition, or whether they should make any efforts to resuscitate you.
I know these are some heavy things to deal with, but we can’t put these decisions off to another day. Let’s face it; we don’t know if we will be here tomorrow. You might recall I was in a motorcycle crash. Thank goodness I was only in the hospital for three days, but it could have been much worse.
Do you think you need to have a lawyer draw up a will? If so, you are not alone. It’s a common misunderstanding. While having a lawyer isn’t necessary, it might be a good idea. If a lawyer works with you on creating a will, then he/she will be able to address any concerns following a death. So, you might be asking if a lawyer is not needed, how do you get a will made? There are some other alternatives. You can buy forms to draft a will online or in a store. Several internet-based companies will guide you through creating a will on their websites, generally for a fee. You can also purchase software that will walk you through the process of creating a will.
